Will the Supreme Court Allow Challenges to the Texas Abortion Ban?

Sonali Kolhatkar speaks with Jessica Mason Pieklo, the Executive Editor of Rewire News Group and co-host of their podcast Boom! Lawyered. She is a writer and adjunct law professor in Boulder, Colorado.

Supreme Court justices in a 3-hour hearing on the sweeping Texas abortion ban Monday seemed inclined toward allowing abortion providers to legally challenge the law. Currently, there is an effective abortion ban in Texas and it is not clear if the justices will allow abortions to resume while lower courts consider any forthcoming challenges. The nation’s highest court in a midnight decision two months ago refused to block the ban, leading anti-abortion activists to declare a major victory.

On Monday, outside the court, hundreds of pro-abortion activists gathered to make their voices heard as inside the court, Justice Elena Kagan questioned the logic of the Texas ban. After the hearing lead Attorney Marc Hearron who represented abortion providers, addressed reporters outside.
