Liberal Supreme Court Justice Stephen Breyer announced this week that he will be retiring after 27 years on the bench. This means that President Biden will get his first out of an uncertain number of Supreme Court picks. It’s excellent news that Breyer is retiring.
Even though progressives won’t gain a seat on the bench, as a liberal justice will just be replaced with a liberal justice, it does mean that there’s no longer a concern about a now 83-year-old Breyer retiring or passing away during the next administration, which could very well be Republican.
Biden doubled down on his campaign promise, saying he will move to appoint the first black woman to the court. Many conservatives are criticizing this, saying Biden is using identity politics instead of simply choosing the most qualified person for the job. These same people were silent when Presidents Reagan and Trump vowed and followed through on putting women on the court.
