The Biden Department of Justice is making the politically risky move of appealing a Florida judge’s decision that the CDC’s mask mandate has to end. On Monday, Judge Kathryn Kimball Mizelle struck down the requirement that people wear masks on airplanes and public transit. This led to many people rejoicing and shedding their masks while concerning others about becoming more susceptible to catching COVID. The CDC said, "CDC will continue to monitor public health conditions to determine whether such an order remains necessary. CDC believes this is a lawful order, well within CDC's legal authority to protect public health." Regardless of whether appealing the strike down makes sense from a public health standpoint, it could be risky for Biden and the Democrats to try to put these rules back in place so close to the midterms, especially when, for many, pandemic fatigue has set in and they don’t want to deal with the mandates anymore.
